Can someone who declared Bankruptcy serve as Director of a Charity?

B"H

Q. Can someone who declared Bankruptcy serve as Director of a Charity?

Short Answer: Yes, in some cases, no, in others.

Comprehensive Answer: It depends on how the Charity is organized.

If the Charity is organized as an Association, then any or all of the Directors may be Bankrupt.

If the Charity is organized as a Corporation, then while the prospective Director is Bankrupt, s/he may not be appointed as a Director.

However, once the bankruptcy ends, s/he may act as Director of a Corporation.
